Terms and Conditions
Terms and Conditions for Fyoody, Fyoody Partner and Fyoody Driver.
Effective date: October 01, 2026
Operated by: Nexasource Technologies Private Limited
Support: support@nexasourcetechnologies.in
1. Scope and acceptance
These Terms govern the Fyoody customer app, Fyoody Partner, Fyoody Driver, related websites and platform services operated by Nexasource Technologies Private Limited.
By accepting these Terms and using the relevant services, you agree to the applicable provisions.
Restaurant and delivery-partner services may also be governed by separately accepted onboarding or commercial agreements.
Those agreements govern role-specific matters where expressly stated, subject to mandatory law. These Terms do not replace required merchant, delivery-partner or employment-related arrangements.
2. Eligibility and Accounts
You must be at least 18 and legally capable of entering into a binding agreement.
Business representatives must be authorized to act for the business. Merchants and delivery partners must satisfy applicable onboarding, licensing and eligibility requirements.
Provide accurate information and protect your account and OTPs. Notify us promptly of suspected unauthorized access.
You must not impersonate others, falsify documents, share another person’s account, bypass verification or use the platform unlawfully.
3. Platform role and service coverage
Fyoody provides technology for restaurant discovery, ordering, payments, merchant operations and delivery coordination.
The relevant restaurant supplies the food. Delivery is arranged through the delivery model identified for the order. Fyoody remains responsible for obligations applicable to its own services under law.
Phase 1 service is limited to supported areas of Bengaluru. Serviceability depends on address, restaurant availability, operating hours and delivery capacity.
4. Orders and confirmation
Menus, item availability and delivery estimates may change. Information shown at checkout governs the proposed order, subject to correction of genuine errors and applicable law.
An order is a request until accepted and confirmed through the applicable workflow. Payment authorization alone may not establish restaurant acceptance. Where cash or another pay-later method is offered, confirmation does not require advance online payment.
We may decline or cancel an order for genuine payment, availability, safety, fraud, legal or technical reasons. We communicate the cancellation and applicable refund outcome.
Items or prices will not be materially changed after confirmation without an appropriate explanation and, where required, your agreement.
5. Prices, charges and payments
Checkout shows the payable amount, including applicable item prices, taxes, delivery/platform charges, discounts and optional tips. You must review the total before confirming. Optional charges require an affirmative selection and are not represented as mandatory.
Payments are processed through supported providers, including Razorpay where offered. You must be authorized to use the payment method.
Do not share payment PINs, CVVs or OTPs with delivery partners, merchants or support.
Duplicate debits, failed-payment deductions and payment discrepancies can be reported through support. We investigate them using transaction records and the payment provider’s processes.
6. Cancellations
Cancellation options depend on acceptance, preparation and delivery status.
-
Request cancellation through the app where available, or contact support promptly.
-
Restrictions or applicable charges must be communicated before or when you request cancellation.
-
Preparation or dispatch may limit cancellation, but does not remove statutory rights.
-
Any cancellation deduction must reflect the disclosed policy, applicable law and circumstances.
-
We do not impose cancellation charges contrary to applicable consumer-protection requirements.
-
Platform or restaurant cancellations are assessed separately from customer-requested cancellations.
A cancelled paid order is reviewed for the appropriate refund. Cancellation and refund status are communicated through available channels.
7. Refunds and order complaints
Report missing, incorrect, damaged, unsafe or otherwise deficient orders promptly, with the order ID and relevant details.
We may request reasonable supporting information. Photos may be supplied through an available support channel; the
Customer app does not need a photo-upload feature for you to raise a complaint. We do not reject a legitimate complaint solely because a particular form of evidence is unavailable.
Refund decisions consider the issue, affected items, payment status, applicable law and any required investigation. Remedies may include a refund, replacement or another remedy agreed with you.
Where a refund is approved, we initiate it promptly, generally within seven working days after approval, unless a shorter period is required by law. Credit to the account may take additional time depending on the bank/payment provider.
Refunds normally go to the original payment method. An alternative method requires an appropriate lawful basis and, where necessary, your agreement. Promotional credits are not substituted for a cash refund without your agreement where a monetary refund is due.
Contact support if a refund exceeds the communicated timeframe. Nothing in this policy reduces mandatory consumer rights.
8. Delivery
Delivery times are estimates affected by preparation, traffic, weather, demand and safety conditions.
Provide an accurate address and necessary access instructions and be reasonably available to receive the order.
If delivery cannot be completed, we assess the circumstances and communicate the order/refund outcome. A failed delivery does not automatically justify retaining the entire payment.
Delivery partners must not be asked to violate traffic rules or enter unsafe locations.
9. Food safety and allergies
Restaurants must provide accurate menu information, hold required licences, prepare food safely and comply with applicable food laws.
If you have an allergy or dietary restriction, seek confirmation from the restaurant before ordering. Menu filters and notes do not guarantee absence of allergens or cross-contact.
Report suspected food-safety issues promptly. The allocation of restaurant responsibilities does not exclude any responsibility Fyoody has under applicable law.
10. Restaurants obligations
Restaurants must:
-
Maintain required authorizations and accurate business details.
-
Keep menus, prices, availability and food information current.
-
Fulfil accepted orders safely and accurately.
-
Upload only content they are authorized to use.
-
Protect customer information and use it only for authorized fulfilment/support.
-
Maintain accurate settlement information.
-
Fees, commissions, payout cycles and commercial adjustments are governed by the separately disclosed and accepted merchant agreement.
11. Delivery-partner obligations
Delivery partners must maintain required eligibility, documents and safe operating practices.
Use customer details only for the assigned delivery and authorized support. Do not retain, publish or independently market to customer contact details.
Do not manipulate location, delivery confirmation or earnings records. Do not mark an order delivered before completing the applicable delivery process.
Earnings, deductions, payouts and other commercial terms are governed by the separately disclosed partner agreement and applicable law.
Nothing here determines a worker’s legal status contrary to applicable law.
12. Promotions and credits
Offers apply only where displayed and subject to disclosed eligibility, limits and expiry. We may investigate abuse or fraudulent redemptions. Changes do not retrospectively remove accrued rights contrary to law.
Gift cards, paid stored value or other regulated products are offered only if expressly introduced with applicable terms. Mention of an offer does not mean every feature is currently available.
13. Content and acceptable use
Do not submit unlawful, fraudulent, abusive, discriminatory or infringing content, harass others, disrupt services or attempt unauthorized access.
You retain rights in content you submit, while granting us permission to host, display and process it as necessary for the feature and lawful platform operations. This does not transfer ownership of your personal information.
We may remove unlawful content or restrict misuse, subject to applicable law and appropriate complaint handling.
14. Suspension and termination
We may proportionately restrict access for fraud, safety risks, legal requirements, nonpayment or material violations.
Where appropriate and lawful, we provide an explanation and a way to contact support. Restrictions do not automatically extinguish valid refunds, accrued settlements or consumer rights.
You may stop using the service and request account deletion.
15. Account deletion
Use the deletion option in the relevant app’s account/profile settings. Also we below link for more information.
https://www.nexasourcetechnologies.in/delete-account
Under the current workflow, access is deactivated when the request is accepted and eligible account data is scheduled for permanent deletion after seven days.
During that period, the same phone number cannot log in or create a replacement account. Contact support within seven days if the request was accidental; reversal depends on verification and whether deletion has already occurred.
Specific records may be retained only for lawful purposes explained in the Privacy Policy. Deletion is not merely account freezing and does not remove outstanding refund or settlement rights.
16. Privacy
Our Privacy Policy explains information handling:
https://www.nexasourcetechnologies.in/privacy-policy
Permission requests, consent choices and privacy rights operate as described there and under applicable law.
17. Intellectual property
Fyoody branding, software and platform materials are protected by applicable rights. Use is permitted only as necessary for authorized platform access. Restaurant and third-party content remains subject to its owners’ rights. Restrictions on copying, interference and reverse engineering apply only to the extent permitted by law.
18. Availability and liability
We aim to provide reliable services but cannot guarantee uninterrupted availability or exact delivery estimates.
Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including applicable consumer rights, responsibilities for our own services or other non-excludable obligations.
Restaurant responsibility and third-party involvement do not operate as a blanket disclaimer of Fyoody’s legal obligations.
19. Governing law and disputes
These Terms are governed by Indian law. Contact our grievance officer first if you wish to seek informal resolution. This is not a mandatory condition that prevents you from exercising a legal remedy.
You may approach the consumer commission, court or authority having jurisdiction under applicable law. These Terms do not impose Bengaluru as an exclusive forum where that would restrict a statutory right.
20. Changes
We publish material changes with a revised date and provide additional notice where required.
Changes apply prospectively except where law requires otherwise. Fresh acceptance is obtained where required. Changes do not retrospectively remove mandatory rights or alter a completed transaction unlawfully.
